Allgemeine Geschäftsbedingungen (AGB) – English version. Last updated: October 2026.

1. Scope and contracting party

These Terms and Conditions apply to all orders and purchase contracts concluded via tokiol.io or by e-mail enquiry with CARTON e.U., Arsenal Objekt 3, Top 64, 1030 Vienna, Austria, FN 653209b, UID ATU82244518 (hereinafter “Tokiol”, “we”). Tokiol is a brand of CARTON e.U. Where these Terms refer to “consumers”, this means consumers within the meaning of the Austrian Consumer Protection Act (KSchG). Mandatory consumer protection provisions remain unaffected.

2. Products

We sell original artworks, limited editions and prints, and publications (catalogues, zines, books). Each artwork is described with artist, title, year, medium, dimensions and, where applicable, edition size. Images are reproductions; slight colour deviations from the original are possible. Unique works and hand-finished editions may show traces of the artistic process; these are characteristics of the work, not defects.

3. Conclusion of contract

(a) Works with a displayed price: The presentation on the website is an invitation to order. By completing checkout you make a binding offer. The contract is concluded when we send the order confirmation or dispatch the goods, whichever is earlier.
(b) Works marked “Price on request”: Your enquiry is not an order. We will send you an individual offer by e-mail including price, shipping and payment terms. The contract is concluded when you accept this offer in writing (e-mail is sufficient). Offers are valid for 7 days unless stated otherwise; works remain available to other buyers until acceptance.
(c) The contract language is English. The contract text is stored by us and sent to you with the order confirmation.

4. Prices, taxes and duties

All prices are in euro (EUR). For deliveries within the European Union, prices include the applicable value added tax. For deliveries outside the EU, prices are shown without EU VAT. For shipments to the United States, import duties and taxes are prepaid by us (delivered duty paid) and are covered by the shipping cost shown at checkout. For all other destinations outside the EU, import duties, customs clearance fees and local taxes of the destination country are borne by the customer and are collected by the carrier or customs authority. Shipping costs are shown at checkout or, for works priced on request, in the individual offer.

5. Payment

Payment is due upon conclusion of the contract. We accept the payment methods shown at checkout (credit/debit card, PayPal and further methods as offered). For works priced on request we also accept bank transfer (SEPA); the work is reserved for you for 7 days after the offer is accepted and is dispatched after receipt of payment.

6. Retention of title

The goods remain the property of CARTON e.U. until full payment has been received (Eigentumsvorbehalt).

7. Delivery, shipping and transfer of risk

We ship from Vienna, Austria. Our works (giclée prints, framed and unframed, and other works) are prepared, finished and packed for you after your order and, unless the product page or our offer states otherwise, are dispatched within approximately one month after receipt of payment; transit time comes in addition. Publications and zines held in stock are dispatched within 3–5 working days after payment. Delivery times stated are estimates. For consumers, the risk of loss or damage passes to you when you or a third party designated by you (other than the carrier) takes possession of the goods (§ 7b KSchG). Please inspect the parcel on receipt and report visible transport damage to us within 48 hours with photographs; this helps us to assert claims against the carrier and does not limit your statutory rights.

8. Right of withdrawal (consumers)

Consumers have a statutory right to withdraw from distance contracts within 14 days without giving reasons. Details, exceptions and the model withdrawal form are set out in our Right of Withdrawal page, which forms part of these Terms.

9. Warranty and liability

The statutory warranty rules apply (for consumers: two years from delivery under the Austrian Verbrauchergewährleistungsgesetz, VGG). Descriptions of artworks, including attribution and edition details, are given to the best of our knowledge and are confirmed by a certificate of authenticity or the artist’s signature/edition numbering where stated. We are liable without limitation for damage caused intentionally or by gross negligence and for personal injury. Liability for slight negligence is excluded, except for damage to persons and claims under the Product Liability Act (PHG). This does not limit mandatory consumer rights.

10. Copyright and use of artworks

Purchase of an artwork transfers ownership of the physical object only. Copyright and all exploitation rights (reproduction, distribution, public display for commercial purposes, digital use) remain with the artist (§§ 14 ff. UrhG). Resale of works through art market professionals may be subject to the artist’s resale right (Folgerecht, § 16b UrhG).

11. Data protection

We process personal data in accordance with our Privacy Policy.

12. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence. For entrepreneurs, the competent court in Vienna, Austria has exclusive jurisdiction. For consumers, the statutory places of jurisdiction apply (§ 14 KSchG).

13. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. For questions or complaints, please contact contact@tokiol.io.
