Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods (for an order delivered in several parts: of the last part).

To exercise the right of withdrawal, you must inform us – CARTON e.U. (Tokiol), Arsenal Objekt 3, Top 64, 1030 Vienna, Austria, e-mail contact@tokiol.io – of your decision by an unequivocal statement (e.g. a letter sent by post or an e-mail). You can also declare your withdrawal online, at any time during the withdrawal period, using the button “Withdraw from contract” (Vertrag widerrufen) on our website: tokiol.io/pages/withdraw. No account or login is required. After you confirm your declaration, we will immediately send you an acknowledgement of receipt by e-mail stating its content and the date and time of receipt. You may use the model withdrawal form below, but it is not obligatory. To meet the deadline, it is sufficient to send your communication before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision. We will use the same means of payment as you used for the initial transaction unless expressly agreed otherwise; you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earliest.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. For goods that can be sent by post (e.g. prints and publications), you bear the direct cost of returning the goods, using the carrier of your choice. For artworks that cannot normally be returned by post because of their size or fragility (e.g. framed or stretched works), we arrange insured collection by our carrier and bear the cost of this return transport. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions

The right of withdrawal does not apply to contracts for goods made to the consumer’s specifications or clearly personalised (§ 18 Abs. 1 Z 3 FAGG), such as commissioned works, works altered at your request, or framing produced to your specification.

Returns outside the right of withdrawal

Our statutory warranty obligations remain unaffected. If a work arrives damaged, please contact us within 48 hours with photographs of the packaging and the work; we will arrange replacement, repair or refund in accordance with the law.
